📝 Terms & Conditions – Peyton & Charmed Bookings

1. Our Role

Peyton & Charmed is a booking coordinator for services on Koh Chang — including tours, transfers, activities, and accommodations (referred to as “providers”).
We do not own, operate, or control these services. Our role is to connect you with trusted local providers and arrange your booking.

2. How Our Pre-Authorization Booking System Works

We use a Pre-Authorization system to make bookings safe and secure. This means your card is temporarily held for the booking amount but not charged immediately.

Step-by-Step:

  1. You submit your booking and card details.
  2. Our system places a temporary hold on the booking amount (no payment taken yet).
  3. We confirm availability with the provider and update you within 3 hours.
  4. If confirmed: We charge your card and send you a Booking Confirmation.
  5. If not confirmed: The booking is cancelled automatically, and the hold is released.

⏳ The time it takes for funds to reappear in your account depends on your card-issuing bank.

Key Points:

  • No fees if we do not charge your card.
  • Release/refund time for a hold depends on your bank.
  • Only works with credit/debit cards (not QR Code, PromptPay, etc.).

3. Booking Status

  • Entering card details or seeing a temporary hold does not mean your booking is confirmed.
  • All bookings remain “Pending Confirmation” until the provider confirms.
  • Please wait for our Booking Confirmation before making other travel plans.

  • Confirmation will depend on provider availability.
  • Open Daily: 09:00 – 22:00hrs. (Thailand Time)
  • Requests outside these hours will be handled the next business day.

5. Cancellations & Refunds

5.1 Role as Booking Agent

Peyton & Charmed Koh Chang acts solely as a booking agent for tours and activities operated by independent third-party providers. We do not operate the tours ourselves. While all bookings are ultimately subject to the respective provider’s terms and conditions, we will make every reasonable effort to liaise with the provider on your behalf to ensure a smooth and satisfactory customer experience.
Peyton & Charmed Koh Chang shall not be held responsible for any loss, damage, injury, delay, or expense arising from the acts or omissions of the provider, or from circumstances beyond our reasonable control.

5.2 Customer-Initiated Cancellations

  • Once confirmed and charged, bookings are non-refundable. Any refund will be processed in accordance with the provider’s refund policy.
  • No-shows or late arrivals on the day of the tour are strictly non-refundable.

5.3 Company/Provider-Initiated Cancellations

  • In the event that the provider cancels a booking due to weather conditions, safety concerns, operational requirements, or other unforeseen circumstances, customers will be offered the choice of:
    a) Rescheduling the booking to an alternative date (subject to availability), or
    b) Receiving a refund in accordance with the provider’s refund policy and at the provider’s sole discretion. Peyton & Charmed Koh Chang will provide reasonable assistance to facilitate such refunds but cannot make refund decisions on behalf of the provider, and we cannot guarantee the approval of any refund or rescheduling request made to the provider.

5.4 Changes to Bookings

  • Requests to change the booking date submitted more than 3 calendar days prior to the tour date will be accommodated without additional charge, subject to availability.
  • Requests submitted less than 3 calendar days prior to the tour date may incur a rebooking fee or be treated as a cancellation, in accordance with the relevant provider’s policy.

5.5 Provider’s Terms Apply

All bookings are subject to the specific cancellation, refund, and rescheduling policies of the provider. In the event of any conflict between these Terms & Conditions and the provider’s policy, the provider’s policy shall prevail.

5.6 Force Majeure

Neither Peyton & Charmed Koh Chang nor the provider shall be held liable, or required to issue refunds, for cancellations or service disruptions caused by events beyond their reasonable control, including but not limited to natural disasters, political unrest, public health emergencies, or transportation strikes, except where otherwise required by applicable law.

6. Duplicate Bookings

  • Do not book the same service or time slot with multiple agents.
  • Duplicate bookings may be cancelled, and we cannot guarantee re-booking.

7. Insurance Coverage

When you book through Peyton & Charmed, you are covered by basic travel accident insurance during the activity, issued and underwritten by our insurance partner (AXA Insurance Public Company Limited.) Peyton & Charmed is not the insurer.

Coverage, benefits, limitations, and exclusions are as stated in the insurer’s official policy. Customers must read and understand the policy before travel.
Any claims, disputes, or compensation requests must be made directly to the insurer under their procedures. We can help submit documents but cannot approve or guarantee claim outcomes.

Coverage Summary (per person):

  • Loss of Life / Dismemberment / Loss of Sight / Permanent Disability (Accident): 1,000,000 Baht
  • Medical Expenses due to Accident (incl. dangerous sports): 500,000 Baht
  • Third-Party Liability: 100,000 Baht
  • Max trip length: 15 days

Important: Customers are required to notify us at least 7 business days in advance to be eligible for travel insurance coverage.

For more protection, you may purchase additional insurance before travel.

8. Limitation of Liability

Peyton & Charmed is not responsible for:

  • Accidents, delays, damages, losses, or injuries caused by providers, other participants, or force majeure events.
  • Any event, cost, or loss not covered by the insurance policy.
  • Situations where customers fail to follow safety instructions, laws, or health guidelines.

Customers are responsible for ensuring they meet all requirements for participation in the booked activity, including age, health, fitness level, and any legal documentation required.

By booking, you agree to release Peyton & Charmed from any liability beyond the scope of the insurance policy.

9. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of Thailand. Any disputes shall be subject to the exclusive jurisdiction of the courts of Thailand.
